Victims of Human Trafficking will not need to pay for review of residence permit documents

The Ministry of Interior (IeM) today, on June 29, 2006, submitted for review at the State Secretary Meeting the draft Regulations of the Cabinet of Ministers “Regulations on the State Duty for Review of Documents Necessary for Requesting a Visa, Residence Permit or the Permanent Inhabitant’s Status in the European Community and Related Services”.


The Regulations fix the amounts of state duty for review of documents necessary for requesting a visa, residence permit or the permanent inhabitant’s status in the European Community (EC) and related services.

 

The Regulations provide to relieve from payment of state duty for review of the necessary documents for term residence permit the foreigners who have been admitted to be victims of human trafficking. By these regulations Latvia will implement EC directive „Residence permit issued to third-country nationals who are victims of trafficking in human beings and who cooperate with the competent authorities”.

 

In turn, in order to implement EC directive „ Right of Union citizens and their family members to move and reside freely within the territory of the Member States”, the draft of Regulations provides to relieve from payment of the state duty the citizens of the European Union member countries, European Economic zone countries and Swiss Confederation and their family members who have submitted for review the documents for receipt of term residence permit or registration or renewal of residence permit if the traveling document is changed.

 

In addition, the Regulations include a section about the amount of the state duty for review of documents submitted for receipt of EC permanent inhabitant’s status in the Republic of Latvia whose implementation has been fixed in the law adopted by the Saeima on June 22, 2006 „On the Status of EC Permanent Inhabitant in the Republic of Latvia”.

 

It is planned that for the documents submitted for receipt of EC permanent inhabitant’s status in the Republic of Latvia a differentiated state duty will be payable whose amount will depend on the time necessary for review of documents and the applicants’ legal status at the moment of submission of documents. Third country citizens for review of documents within 90 days will have to pay Ls 70, for review of documents win 30 business days – Ls 120, but for review of documents in 10 business days – Ls 170. Latvian non-citizens and foreigners, who before obtaining of another state citizenship were the citizens or non-citizens of Latvia, for review of submitted documents in 90 days shall pay the state duty in the amount of Ls 20, in 30 business days – Ls 50, but in 10 business days - Ls 70. For review of documents submitting for requesting of status the state duty will be payable before review of documents.

 

Currently the amount of the state duty and its payment procedure is provided in the Regulations No. 84 of the Cabinet of Ministers dated January 31, 2006 “Regulations on state duty for review of documents necessary for requesting a visa or residence permit and related services”, which fully do not comply with the provisions of the above mentioned directives.
