On Cover of Expenses for Officials Related to Training

In the meeting of State Secretaries on September 7, the draft Regulations prepared by the Ministry of Interior have been annoandced, which provide the procedure, in which the officials of the Ministry of Interior (IeM) system’s establishments and Imprisonment Places Administration (IPA) with a special service rank are being compensated for the expenses related to training, as well as provide their repayment terms and procedure and the expenses related to acquire of professional education and their repayment procedure

The project provides unified criteria and procedure for all establishments, in which the officials perform their service. Having realized the requirements of a legislative enactment, it is expected that the level of officials’ professional qualification will increase, which will directly impact the services, which are provided to the society by the State Police, the State Border Guards, the State Fire Safety and Rescue Service and other institutions, to which these Regulations refer. This may increase the feeling of safety and the prestige of respective establishments in the society.

Until October 1, 2006, when the law on service procedure of IeM system establishments’ and IPA officials with special ranks will come into force, which will provide the general principles of covering expenses related to raising of qualification and training of officials with special service rank, the partially mentioned issues are regulated by different regulations of the Cabinet of Ministers (CM).

Currently IeM system establishments’ specialized state civil service officials are subject to the CM Regulations of February 1, 2005 No. 72 „Rules on Service Procedure of Specialized State Civil Service Officials – Police Employees, Border Guards and State Fire Safety and Rescue Service”. These Regulations provide payment of compensation if an official, without interrupting the service, successfully studies in a Latvian higher educational establishment against a charge in order to get the knowledge necessary for performance of service duties. However, here no specific number of years is fixed here what the official should serve after completion of higher educational establishment, it gets provided in the agreement, therefore each head of an IeM system’s establishment may fix a different number of years according to its discretion. In addition, also other norms of the Regulations No. 72 are unspecified and differently interpreted.

Whereas, the Ministry of Justice IPA specialized state civil service officials are currently subject to the IPA law and the CM Regulations issued on its basis - No. 282 dated May 27, 2003 „Procedure, in which an Imprisonment Places Administration’s and Imprisonment Places Administration General Inspector’s Office specialized state civil service official is compensated and the official is repaying expenses related to training”. These regulations clearly prescribe the procedure, in which a specialized civil service official is compensated and the official is repaying expenses related to training if he, without interrupting the service, successfully studies in a Latvian higher educational establishment against a charge in order to get the knowledge necessary for performance of service duties. Other issues related to raising of qualification are not provided in legislative enactments regulating IPA activities.

However, the major problem is connected with the fact that the capacity of IeM system’s special education establishments is insufficient in order to ensure that all officials get the knowledge necessary for performance of duties. According to Clause 9 of the Service Procedure Law and the requirements fixed in job descriptions, the officials, who take the positions from lieutenant to the general’s special service rank, require higher education. According to Clause 8 of the Transitional Regulations of the Service Procedure Law, until July 1, 2016 the position of an official may be taken also by the person who has no respective education compliant with the job requirements. During the time until July 1, 2016 the officials, who have no respective education, will start, continue or complete gaining of this education.

Currently the most part of service officials has no possibility to stop performance of service duties in order to undergo full-time studies in the Latvian Police Academy and other educational establishments of IeM system. Therefore the officials serving in the State Police have chosen to get lawyer’s profession in other accredited Latvian higher educational establishments, which have branch offices in the Latvian territory and have a possibility to combine the performance of service duties with training, which might be only a temporary solution.

In order to materially improve the possibilities of getting respective education, IeM has performed reorganization of educational establishments by establishing the State Police college.
Totally in the year 2006, for covering of expenses related to training the budget of IeM has planned to allocate 106.3 thousand lats, but IPA budget – 22.4 thousand lats.
