Several offenses have been identified during the examination of the service, as a result of which the Minister for the

  • will ask the Procurement Monitoring Bureau to initiate administrative violation proceedings in connection with possible violations of Sections 84 and 86 of the Public Procurement Law;
  • initiate disciplinary proceedings against the head of the Information Center of the Ministry of the Interior in connection with a possible disciplinary violation provided for in Section 36, Paragraphs one, two or three of the Civil Service Officials Law;
  • instruct the Information Center of the Ministry of the Interior to evaluate the actions of the employees of the Information Center of the Ministry of the Interior included in the procurement commissions by the procedures specified in Section 90 or 101 of the Labor Law;
  • will evaluate the possibilities of further cooperation with the successful bidder in the procurement procedure SIA “KB Open”.

The examination did not reveal any violation of the restrictions specified in Section 11, Paragraph one of the Law On Prevention of Conflict of Interest in the Activities of State Officials, which would give rise to believing that the former Parliamentary Secretary of the Ministry of Interior, S.Bole, in the performance of the duties of a State official, would have conflicted with interest situation.

The Information Center of the Ministry of the Interior opted for a negotiated procedure rather than an open competition in the situation. The inspection of the Service concluded that the circumstances indicated by the Information Center of the Ministry of the Interior as the contracting authority for the application of the negotiated procedure cannot be recognized as unforeseeable extraordinary circumstances within the meaning of Section 8, Paragraph seven, Clause 3 of the Public Procurement Law. This indicates significant restrictions on competition and the free market on the part of the Information Center of the Ministry of the Interior as the contracting authority while there are risks of inefficient use of state budget funds.

The Service Inspection Commission has also identified significant errors in the work of both procurement commissions that had a direct impact on the results of the procurement procedure, as a result of which the tenderer whose tender did not meet the requirements set in the procurement procedure documents was recognized as the winner of the procurement procedure.
